Terms & Conditions.
Prices do not include GST.
Fees include all reasonable consumables.
Couriers, art supplies and other auxiliary materials billed at cost, and are quote as an allowance on each job estimate if applicable/foreseeable.
An estimate must be signed before any of the outlined work may commence.
70% of signed off estimates must be paid before work will commence.
100% Balance must be paid before handover.
All quotes are estimates based on the information provided by the client and suppliers. Quotes are subject to change upon sighting of client delay, lack of content, client delays for collateral handover and any other circumstances that may affect the job. Quotes do not, generally, include couriers, out-sourced artwork/photography/illustration/copy writing or other ‘out of pocket’ expenses, these will be additional. Quotations are only valid for 30 days from date of issue or within time to allow 3 weeks before tender submission.
It is preferred that clients provide written acceptance of all quotes. Verbal acceptance will be confirmed in writing by The Bid Coordinator. Work on any jobs will not commence without acceptance. Acceptance of the quotation will also be acceptance of our terms and conditions.
All invoices are strictly 7 days. An initial deposit on approval (70%) will be required before commencement. Jobs that continue over an extended period of time will be invoiced as they progress, normally every week.
Any jobs that are cancelled at the client’s request will be invoiced for any work or expenses completed up to that point.
All quotes prepared by The Bid Coordinator are based on the work being provided to The Bid Coordinator in a timely fashion in order to meet deadlines. The Bid Coordinator reserves the right to charge a loading for ‘rush’ deadlines which are imposed by the client. The Bid Coordinator will NOT accept responsibility for errors in rush jobs.
It is agreed that the fee for service shall be the cost estimates provided under the ‘time and cost estimate’ section of this submission, unless work undertaken exceeds work outlined. If work undertaken exceeds the items specified under the ‘items to be produced’ section of this submission, the client agrees to pay appropriate fees for the excess work.
Copyright does NOT extend to the use of design proposals submitted but not approved by the client for the work outlined in this submission.
All copyright and other intellectual property rights of whatever nature belong to The Bid Coordinator and NOT to the client until all payment has been made final.
It is agreed that employees of The Bid Coordinator shall not, at any time either during the continuance of the work outlined or thereafter, except in the course of their duties, divulge any of the confidential affairs of the client or any of its clients or associated companies to anyone whatsoever without the previous consent in writing of the client.
Final approval of any content is at the discretion of the client. The Bid Coordinator is not liable for any losses, claims, damages or costs, financial or other, resulting from errors or inaccuracies in the work. All required information needed to complete the document must be provided by the client in sufficient time to enable the response to be developed. For the avoidance of doubt, this assumes a response to questions and requests
Unless you specifically request us not to, The Bid Coordinator reserves the right to refer to your project and your business name to indicate services have been provided by us to you, and we may also provide copy we have written for you to third parties where project has been awarded as examples of our work. Any materials used by The Bid Coordinator for such purposes will not contain commercially sensitive information or confidential information.
Project quotes are based on the assumption that the Bid Coordinator will receive content and feedback within 24-48 hours of request. If feedback from the client takes longer we will consider the deliverable approved and will proceed with the next piece of work. Any large or excessive changes, or missed client content handovers late in the (very short) tender process will put us over these numbers. If this occurs, The Bid Coordinator will provide you with advanced notice and the opportunity to proceed at an agreed hourly rate. Alternatively, this may put the project on hold and may reduce the quality of the result.
The Bid Coordinator is dedicated first and foremost to delivering all tenders on time. Where client information handover is exceptionally late and results in critical path delays, additional charges to the client for out-of-hours works (occurring between 6pm-7am) will result in double time rates for each staff member per hour. Please note that The Bid Coordinator reserves the right to refuse work where client delays have led to drastic project delays and may not always be able to work out of hours.
The Bid Coordinator has a copywriting process in order to best achieve high quality results. However, due to the short nature of projects and the large quantity of information processed, all documents
must be reviewed by the client. Errors and omissions are the client’s responsibility and they will be given several opportunities to review the document prior to submission.InDesign files and templates for tenders produced by The Bid Coordinator for the client are available for a further cost to the client and available upon final payment.
In the event that any of the provisions of this agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.
Except to the extent paid in settlement from any applicable insurance policies, and to the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other Party, and its respective directors, shareholders, affiliates, officers, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result from or arise out of any act or omission of the indemnifying party, its respective directors, shareholders, affiliates, officers, agents, employees, and permitted successors that occurs in connection with this Agreement. This indemnification will survive the termination of this Agreement.
Should the Client be in dispute as to the invoice amount or standard of services provided by The Bid Coordinator the Client must address said dispute with The Bid Coordinator Pty Ltd immediately upon receipt of invoice. During any dispute, interest may be charged on any amount outstanding after 30 days from date of invoice at a rate of 12% per annum, and shall accrue daily until the outstanding balance is paid. If we incur any costs of collection, such as legal fees and collection agency fees etc., you agree to indemnify us for all such costs.
The Bid Coordinator Pty Ltd reserves the right to discontinue the Services in cases where the Client has not made payment on outstanding invoices during the course of provision of the Services.
The Client shall indemnify The Bid Coordinator Pty Ltd in full for all costs, losses either direct or indirect in any way incurred by the Client; and, where any such action by the Client causes loss or damage or liability of any kind howsoever to The Bid Coordinator Pty Ltd in connection in any way with the Services rendered.
These terms and conditions shall be governed by the law of the state in which the Services are to be undertaken and the parties submit to the jurisdiction of the Courts of that State.
The Bid Coordinator Pty Ltd Referral Program Terms and Conditions
1. Introduction
These terms and conditions govern the The Bid Coordinator Referral Program. By participating in the program, both referrers and referred customers agree to these terms.
2. Eligibility
Participants must be 18 years of age or older.
Employees of The Bid Coordinator and their immediate family members are not eligible to participate.
The referral program is open to existing clients and the general public, and may be declined upon individual basis.
3. How to Refer
Participants must submit referrals through the designated referral form on our website or by using the official referral slips provided by The Bid Coordinator.
Referrals must include the full name, contact information, and any other details required by The Bid Coordinator for both the referrer and the referred party.
4. Qualifying Referrals
A qualifying referral is a new client introduced to The Bid Coordinator by a participant, resulting in a signed contract and completed services valued at a minimum $18,000, excluding taxes.
The referred client must not have been in contact with The Bid Coordinator for the past 6 months, and must not have previously engaged The Bid Coordinator for services.
5. Referral rewards
For each qualifying referral, the referrer will receive $1,000 AU direct, subject to the conditions outlined herein.
Rewards are subject to change and may be replaced with rewards of equivalent value without prior notice.
6. Distribution of Rewards
Rewards will be distributed within 1 month after the referred client's project has commenced/has been paid in full.
Rewards are non-transferable and cannot be exchanged.
Where it is found that the referral was made in error, the recipient agrees to return the award received.
7. Limitations
There is no limit to the number of referrals an individual can make; however, The Bid Coordinator reserves the right to limit rewards to 5 per referrer per calendar year.

8. Legal and Compliance
Participants are responsible for any tax implications resulting from receiving a reward.
The Bid Coordinator complies with all applicable laws and regulations, including privacy laws. Personal information collected during the program will be processed as per our Privacy Policy.
9. Modification and Termination
The Bid Coordinator reserves the right to modify or terminate the referral program at any time, without liability to the participants. Notice of any changes or termination will be provided.
10. Disputes
Any disputes related to the referral program will be resolved by The Bid Coordinator at its sole discretion. Decisions by The Bid Coordinator are final and binding.
11. Governing Law
These terms and conditions are governed by the laws of NSW, Australia.
